:, <br />(Page 2) • <br />MINE ID # OR PROSPECTING ID # M-97-094 <br />INSPECTION DATE 6/30/96 INSPECTOR'S INITIALS AJW <br />OBSERVATIONS <br />This was a monitoring inspection conducted by Tony Waldron as a result of a citizen's <br />complaint. Present during the inspection were Ferd Mueller representing Siloam Stone and Joe <br />O'Brien representing Red Creek Ranch. The complaint alleged that mining was occurring of the <br />permitted area and thaC blasting had occurred in violation of permit conditions. <br />There appears to be some confusion about the amount of disturbance allowed under this permit. <br />The mine site is located approximately 25 miles west of Pueblo, Colorado on Siloam Stone <br />Road. There are actually three separate mines located in close proximity to each other. <br />These are the Bedrock Mine, File # m-97-086, the Pinon Mine, File # m-97-094, and the Adience <br />Mine, File # M-77-326. The latter two mines are both permitted to disturb less than 10 acres <br />and the Bedrock mine is permitted to disturb 329 acres, with no more than 15 acres of quarry <br />and 5 acres of surface stone extraction at any one time. As a result of the three mines <br />being in close proximity to each other, the resulant total disturbance can equal almost 40 <br />acres at any given time. This was explained in some detail and all parties indicated an <br />understanding of this fact which seemed to sastify the first part of the complaint. To <br />verify that no more than 5 acres of surface stone extraction was occurring those sites were <br />inspected and it was verified that no more than 5 acres were disturbed including roads. <br />Also, all of the surface rock picking that is occurring is within the 160 acre non-conforming <br />use area. <br />The second part of the complaint alleged that blasting had occurred on the site which is <br />currently pzohibited until a new blasting plan is submitted by the operator and approved by <br />the Division. The operator was questioned as to whether any blasting had occurred on either <br />of their permitted sites since September of 1997 when the Division last conducted an <br />inspection and required all blasting to stop until a blasting plan was approved. The <br />operator unequivocally stated that no blasting had occurred since that time and based on this <br />inspection it was clear that none was presently occurring. The operator is still in the <br />process of preparing a blasting plan and will be submitting one For review very soon. <br />Based on this inspection, the operator was operating within the provisions of their permit <br />and the Mined Land Reclamation Act and had not exceeded their approved affected acreage <br />restriction.
