From the information <br />provided, it appears that the dam in question was constructed for the purpose of settling of processor tines <br />from the mining operation and should appropriately he considered as a tailings dam. Per Rule 18.B of <br />the State Engineer's "Rules and Regulations for Dam Safety and Dam Construction", tailings <br />impoundments which are permitted under the Colorado Mined Land Reclamation Act are considered <br />"exempt" structures; i.e., they are exempt from the State Engineer's rules concerning dam construction <br />and dam safety. As a tailings impoundment facility, the dam at this site would need to be permitted by <br />the Division of Minerals and Geology as a part of the operator's mining plan, and is therefore considered <br />an exempt structure under our rules. <br />1 hope this provides the necessary clarification.
