The site as reported in the last inspection was flooded <br />when the Arkansas River breached a portion of it banks in early July. The <br />site was jointly inspected by the DMG and the Army Corps on July 20, 2006, <br />which has primacy on works to be conducted in waters of the United States. <br />The Army Corps had granted an emergency 404 permit to the operator to <br />conduct the repair work. The Division has also granted the operator to <br />impact the 100 foot buffer zone along the banks so the repair work will be <br />implemented. <br />Given the magnitude of the breach and the amount of work needed to repair <br />the road which was part of the breach along that side of the river, as <br />expected, the progress is very slow.
