III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />AVAILABILITY OF RECORDS <br />The Technical Revision Number 44 application (under a P & M Coal Company letter of August 15, <br />2005) was on file at the County Clerk and Recorder's office in the Routt County Courthouse. March, <br />April and June 2005 Colorado Division of Minerals and Geology (Division) inspection reports were <br />found on file. Quarterly pond inspection reports were found on file. Periodic water monitoring reports <br />up through 2004 were found on file. <br />HYDROLOGIC BALANCE <br />All impoundments of the "String of Pearls", except for those silted in, contained water. The three <br />sedimentation ponds were in good repair. Other comments regarding the three sedimentation ponds aze <br />as follows: <br />Im oundment Dischaz e Comments <br /> <br />West Ride none water at invert level <br />Center Ride none <br />Moffat Area none water at invert level <br />However, there was a 0.28 cfs (measured) dischazge at the Colorado Dischazge Permit System (CDPS) <br />point 007 from spoil springs that discharge to the Koll Ditch. <br />No surface flows, except for Koll Ditch, were evident on the site. <br />Water quality measurements were taken at sites above and below the Edna Mine on Trout Creek and <br />other streams about the area. See the map attached for the locations and values. <br />BACKFILL & GRADING <br />Remaining backfill and grading at the Edna Mine is located in long-term mining support facilities. A <br />small amount of grading is currently required with reclamation of a lower (Oak Creek) office facility. <br />The West Ridge Diversion ditch and the Moffat Pond ditch extensions still need to be reclaimed. There <br />was no indication that the three upper tipple ponds had been refurbished to insure positive drainage. <br />SUPPORT FACILITIES <br />An office building and associated parking azea still remain at the Oak Creek facilities azea. There was <br />no sign of recent activity or change in condition. <br />See the discussion above for the condition of sedimentation ponds.
