III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />An aerial inspection of the West Elk Mine was flown on December 21, <br />1994 by Harry Ranney of the Division. Photographs taken of the <br />site were reviewed by Christine Johnston. The photographs are <br />identified as 12/94; x:78; F:009; D:081; R:00; G:07; B:OB and <br />12/94; $:78; F:O10; D:083; R:00; G:07; B:08. The site is snow <br />covered, except for roadways and active work areas, which prevented <br />a detailed inspection. <br />Hydrologic Balance <br />The sediment ponds visible in the photographs, MB-1, FW-1, and MB- <br />2R are holding water and covered with snow. The north cell of MB-1 <br />is being prepared for lining. New culverts C2-15 and C2-3A <br />associated with the material storage bench have been installed. <br />Bs'tckfilling and Grading <br />It appears that the work for the material storage bench is almost <br />complete. The bench appears to be at the final elevation. <br />Material was cut above to form the bench as approved. Topsoil has <br />been stored adjacent to the cut. <br />Excess Spoil and Development Waste <br />Coal refuse is actively being dumped on the top bench of the <br />development waste pile. <br />No problems were noted at the site. <br />oo7.i2zi <br />
