III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />December 11, 2002 by Mike Boulay of the DMG. There were no representatives from Kerr Coal <br />Company present during the inspection. There was no activity at the site. Weather conditions <br />were windy and cold with some light snow. The mine site was entirely snow covered at the time <br />of the inspection. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson Harza office in Steamboat Springs on the <br />afternoon of December 11, 2002. All required records were available for review. Please see the <br />attached Availability of Records checklist. Some minor problems were noted with general <br />organization of the files. Many items that needed to be reviewed were available, but had not yet <br />been filed in the appropriate location. The Division recommends that the files be updated and <br />kept current on a regulaz basis. <br />Roads <br />Road surfaces were snow covered throughout the mine site. Access was very limited due to the <br />icy and snowpacked road conditions. Perimeter azeas at the site were well maintained and no <br />problems were noted. <br />Loadout <br />The entrance road to the loadout was snow covered, but passable. The entire loadout was snow <br />covered. The entrance gate was open and men were working at the site at the time of the <br />inspection. Some rills and gullies aze forming on the reclaimed slope (former lumber mill <br />property located immediately west of the site). Although this property is not associated with the <br />loadout facility, it was also noted that the silt fence at the base of the reclaimed slope needs to be <br />repaired or reinstalled in several locations. <br />
