Operator had set the inspection with the Army Corps and asked the Division to conduct <br />the inspection jointly. The operator had submitted a technical revision to decrease the affected acreage <br />from the Current 10 acres to 4 acres, and wanted a reduction in warranty to reflect the change. The <br />financial warranty for the 10 acres was set at $35,000.00, IN 1992. Since the site was permitted, in 1992, <br />the entire affected acreage is less than three acres, approximately. The main purpose of the inspection with <br />a representative from the Army Corps was to delineate, the wet lands area, that are included with in the <br />permit area. According to the operator, the wetlands areas were surveyed with representatives from the <br />Army Corps in 1999. Before commencing the operation, Gillette Sand and Gravel wanted to make sure the <br />Army Corps was in agreement with the wet land areas within the permit that will not be affected, with out <br />a written approval and agreement with the CORPS. <br />Present during the inspection were, Diana Humphreys of the US Army Corps, Mark Yevoli, Dave Tiptton, Joel <br />Spurlock, Steve Gasken, and Dave Allen of Gillette Sand and Gravel. <br />The entire wetlands area was walked and inspected and the operator agreed to stay out of the wetlands <br />areas. A brief discussion was held on how to build a crossing, over the perennial stream. Miss Humphries <br />informed them of a couple of options that will be in compliance with the Corps. Operator agreed to provide <br />the appropriate applications to the Corps and provide the approval letter to the Division. After looking at <br />the area where the operator plans to resume the mining operation, it was suggested to the operator that <br />four acres of affected acreage might not be enough to commence the operation. Given the amount of <br />material and depth of mining the operator agreed to change the request in the TR, from the 4 acres, to an <br />appropriate acreage. They also agreed to submit a 30-day decision waiver, for the TR. Permit sign and <br />property markers were in place. However, the Division requested a new map showing the delineated <br />wetland areas and the expanded affected acreage, with the letter from the Army Corps, to be incorporated <br />in the TR. <br />On 11-14-02, the Division received a fax fro Mark Yevoli, requesting a 30-day waiver for the TR and also <br />withdrew, his request from the TR, the reduction in affected acreage.
