III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />Mitch Rollings expressed a concern with the lack of hydrology designs for the previously <br />described sediment control system that now exists at the West Mine. The situation is being <br />reviewed by OSM and may result in a Ten Day Notice. <br />There were no signs of erosional gullying at the topsoil stockpile. Topsoil signs were up. The <br />pile was well vegetated. The operator has cut a swath through the topsoil stockpile to provide <br />access to the portal bench for haul trucks. <br />The road leading to the West Mine fan site was in good condition. The mine ID sign was present <br />at the road gate, which was open. <br />At the West Mine fan site, the operator has placed more coal refuse on top of the two backfilled <br />vent shafts. The backfilled shaft material keeps settling. Runoff from the disturbed area reports to <br />silt fence for sediment control. However, Map 8-7 needs to be revised to take out the depiction of <br />a vegetative filter zone upgradient of the silt fence. This will match the SAE designs that are in <br />Volume 8 of the permit application. There were no erosional gullies at the fan area topsoil <br />stockpile.
