III. COMMENTS -COMPLIANCE <br />Below are comments on the inspectron. The comments include discussion of observations made <br />dunng the inspection Comments also describe any enforcement actions taken dunng the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a complete rnspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground mine is reclaimed. Remaining bwldings <br />and structures are approved to remain as permanent structures. Ground conditions were <br />soft and the weather was cool. The landowner, A.J. luppa, was present during a portion of <br />the inspection. <br />Availabrlity of Records <br />The public copy of the mme records is kept at the office of the Las Animas County Clerk at <br />the county courthouse in Trinidad. All required records were easily located. Details of the <br />records inspection can be found on page 2a of this report. <br />Hydrologic Balance <br />The sediment pond is holding <br />water in the south end. The pond <br />was not discharging. Cattails in <br />the north end have died back over <br />the wrnter, likely due to freezing of <br />the pond during colder periods. <br />Ditches and culverts site wide were <br />observed in good condition, No <br />appreciable runoff has occurred <br />this winter due to snowmelt. <br />Processing Waste <br />,.. ,. , ~ - .-. 1.,~ :,.- : ~, e <br />The refuse pile was traversed on ~ ," ~ ;~;•','~'r ,, <br />'~'~- <br />foot. Some evidence of recent grazing was noted. Due to <br />persistent winter moisture and continued warming temperatures, existing vegetation is <br />showing signs of sprouting. Grasses and (orbs were noted, although growth at this time is <br />close to the ground. <br />
