III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Hamilton Mine conducted on November 7, 2006 by Mike <br />Boulay of the DRMS. Dave Andrews, Honeywood Coal Company's contractor was not present <br />during the inspection; but left the records for inspection at the Broad Canyon Landfill office. <br />Weather conditions were sunny and warm. There was no activity at the mine site during the <br />inspection. <br />Availability of Records <br />All required records were available for review. Please see the attached records checklist at the <br />end of this inspection report. <br />Hydroloeic Balance <br />Sedimentation Ponds A and B were inspected. Pond A was dry. Pond B was retaining a <br />significant amount of water at a level above the dischazge pipe intake. However, the gated valve <br />remains shut and therefore the pond was not dischazging. Recent repairs made to the <br />embankment at Pond B remain stable. Pond inlets, dischazge structures and embankments were <br />in good condition and functioning as intended at both pond locations. No problems were noted <br />at either of the sediment ponds. <br />Roads <br />Roads were dry and there was no running water in any of the road ditches. The access road to <br />Pond B was recently repaired and the road remains stable. Roads throughout the site were in <br />relatively good condition. Culverts were cleaz of sediment and debris and capable of functioning <br />as intended. <br />Reclamation Success <br />Ground conditions were dry at the site and vegetative cover still appears to be somewhat sparse. <br />No significant erosion features were noted in any of the reclaimed azeas of the mine site. <br />
