~f <br />III. COMMENTS -COMPLIANCE <br />Below are comments cn the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement ac[ions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. No one represented the operator. <br />Roads <br />The paved entrance road was passable and free of dirt and debris. The east road was passable, <br />and the gate was closed. <br />Facilities <br />The operator has stockpiled coal just east of the grizzly, as well as on the west side of the <br />facilities bench. Trucks were unloadim? and coal railcars were being loaded during the <br />inspection. There were no signs of fugitive Jus[ offsite. <br />The berm around the fuel facility was functional. No fuel leaks were observed. The berm on the <br />outer edge of the facilities bench was also functional. <br />No problems were observed at the material storage area. <br />Hydrology <br />Pond 1 was wet but held no water. Pond 2 was dry. Pond embankments were stable. No gullying <br />was observed on pond inslopes and outslopes. The pond spillways were functional. <br />The straw bales and silt fence along the railroad track sae's were in place and were functional. <br />Topsoil <br />Topsoil signs were present on the topsoil stoxkpiles.
