<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DMG staff <br />from the Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO 81301, <br />phone (970) 247-5469. Jim Hendricks was not available to accompany the DMG <br />inspector. Prior to the inspection, Mr. Hendricks had been conducting reclamation <br />grading at the north pit area but departed to procure additionally supplies. The area <br />has received heavy precipitation throughout August. Road side drainage ditches and <br />culverts were clear and functional. <br />Affected area drainage reports to one of two sediment ponds. Sediment Pond 1, <br />located at the far south end of the permit area, was holding water in isolated pools, <br />pools were less than 0.5' deep. Primary spillway was clear and stable, no discharge <br />noted. Secondary spillway was well vegetated and stable, no evidence of discharge. <br />Pond embankment, inslopes and inlets appeared well vegetated and stable. <br />Sediment Pond 2, located along the west side of the permit area, was holding water, <br />approximately 1' deep. Primary spillway was clear and functional, no discharge noted. <br />Secondary spillway appeared stable, no evidence of discharge. Pond embankment was <br />well vegetated and stable. Evidence of erosion and sedimentation was observed within <br />the sediment containment ditch and pond inlet for Pond 2. Rock check dams in the <br />inlet ditch were intact. However, portions of the ditch have accumulated significant <br />sediment loads. Sediment clean out and ditch maintenance is necessary to ensure that <br />the inlet ditch functions as designed. <br />Significant progress in reclamation backfilling and grading was evident for the north pit <br />area. Coal debris is being backfilled against the cut slope. The backfilled coal debris <br />will be covered with overburden earthen material to attain final grade. <br />Significant progress in reclamation backfilling and grading was also evident at the <br />south end of the Mutual Use Area (MUA-. <br />Fuel storage tanks within the MUA were surrounded by spill containment berms. Fuel <br />tanks appeared intact, no evidence of rupture or leakage. <br />
