A Bite inspection was made to evaluate the extent of disturbance at the Neal Pit. The <br />operator has recently reported to DMG that mining has occured outside of the permitted area. <br />Mr. Roberta ie actively updating all of the permit files held by Montrose County and desires <br />to bring all of the Montrose County pits into compliance with the Mineral Rulee 6 Regulations <br />and the Colorado Mine Land Reclamation Act 34-32-101 Et.Seq., 1973. <br />2. The Neal Pit ie permitted for 8.07 acres of disturbance and was actively being mined at <br />the time of inspection. This inspector took photographs and observed a total mining <br />disturbance of approximately 12 acres. Mr. Roberts expressed a desire to convert the <br />existing 110(2) permit to a regular operation 112 permit as soon as possible. Therefore, <br />application forme are attached to this report. Mr. Roberta was advised to survey the exact <br />acreage of existing disturbance and to submit the results to DMG ae soon as possible. See <br />page 3 for details. <br />3. Mr. Roberts was informed that DMG will send a Reason To Believe letter to Montrose County <br />for mining outside the permitted area and will schedule the operator to appear before the <br />Colorado Mine Land Reclamation Board at the March 20-21, 1996 Meeting. Mr. Roberta was <br />encouraged to submit an application for a 112 conversion as soon ae practicable, if in fact <br />the total disturbance exceeds 10 acres. <br />I & E Contact Address <br />NAME Timothy L.
