III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a partial inspection of the Munger Canyon Mine, including only a site inspection of the reclaimed areas <br />of the access road and mine bench area in Munger Canyon. I was not accompanied by an operator <br />representative. I checked in with a security guard at the mine office prior to inspection, and returned the Munger <br />gate key to its hanger by the office door at the conclusion of the inspection. The primary focus of the inspection <br />was to check abatement of NOV CV-2007-003 Abatement Items 1 and 2. Both items had completion deadlines <br />of 8/30!07, and I was notified on 8/30/07 that the work had been completed. <br />Weather was clear and warm, and site conditions were dry. There apparently has been very little if any <br />precipitation since my previous inspection. The quick guard cover crop has not made appreciable growth since <br />that time. <br />Sturdy, 4-strand barbed wire fencing has been completed around the waste disposal and topsoil stockpile <br />disturbed/reclaimed areas and at the base of the reclaimed canyon road segment, in compliance with permit <br />requirements. <br />NOV CV-2007-003 Abatement <br />Abatement Item No. 1 had been properly completed. The five failed silt fence structures had been replaced or <br />repaired. Also, two additional silt fence segments had been installed along each of the channel berms on the <br />east and west sides of Channel "H", with corresponding berm breaks and water bars as necessary to direct flow <br />through the silt fenced berm breaks. Two additional silt fence structures had been placed along the drainage <br />flow path along the inside of the north side collection berm, and one such "supplemental" silt fence along the <br />east side Channel "H" berm. In a couple locations, primary silt fence installations include two closely spaced silt <br />fence segments in series. Item Properly Abated. <br />Abatement Item No. 2 had been properly completed. A berm break and water bar had been properly <br />constructed as necessary to direct flow of ephemeral channel into Channel "H", where a small tributary channel <br />enters the disturbed area from the west. Item Properly Abated. <br />Abatement /tem No. 3 ("Submit a properly amended Appendix page M(vii)-1 iv...) has not yet been abated. Due <br />date for Abatement Item No. 3 is 9117107. <br />3 <br />
