III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection, oversighted by the Office of Surface Mining (OSM). Joe Dudash <br />and Tom Kaldenbach represented the Colorado Division of Minerals and Geology. Tom <br />Kaldenbach is a recent hire by the State and will be assigned to this mine. Tom Petrosky <br />represented the operator. Henry Austin represented OSM. There had been a fairly hard rain just <br />[he night before the inspection. This spring has been unusually wet. <br />Roads <br />The tie-across haul road was in good shape. The haul road to the grizzly and the access road <br />around the office area were in good shape as well. The outslope of the haul road ditch just east of <br />the entrance gate could use some riprap since downcutting has just begun. The two entrance gates <br />were locked. <br />Sedimentation Ponds <br />The water level in the truck loop pond (pond 1), was up to the top of the horizontal primary gate <br />valve. The gate valve was closed and there was no discharge. The pond 1 inslopes were vegetated <br />and stable. The spillways were functional. Sediment cleanout survey markers were present. <br />At the rail loop pond (pond 2), the water level was about 8 inches below discharge. The <br />combined open channel spillway was functional. The pond embankment appeared to be stable. <br />The pond embankment was well vegetated except for one small area, which the operator intends <br />to seed. The sediment cleanout survey markers were present. <br />Culverts and Ditches <br />All of the culverts were clear and functional. There was some erosion around the inlet to culvert <br />LFC-4. Previous erosion at this area had been filled with riprap, but additional erosion occurred <br />around the side of the riprapped area. The operator stated that they will repair this small area. <br />All of the ditches were functional, although a portion of ditch 9, just before it enters pond 1, will <br />need some touching up soon. Also, there was a section of ditch 3, just south of the light use road <br />
