III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented <br />the operator during the field inspection or records check. <br />Sims and Markers <br />The mine ID sign was up on the entrance gate. The address of the operator has changed so the mine ID <br />sign has to be updated. Surface markers were present around the disturbed area perimeter. <br />Road <br />The road to Pond 5 was in good condition. <br />Hydrolo¢v <br />There was no water in pond 4. Pond inslopes were stable, as was the pond embankment. The discharge <br />tubes were functional. The culvert under the road leading to pond 4 was clear. The water level in pond <br />5 was about 6 inches below the discharge inlet. The gated valve of pond 5 was closed. <br />The collection ditch leading to pond 5 was well vegetated and had sufficient capacity. <br />Reclamation <br />There were no signs of erosional gullys or slope instability with the reclaimed slopes. The reclaimed <br />highwall appeared to be stable as well. There was positive drainage off of the upper and lower <br />benches. There was a good vegetative cover in place. <br />There was a steady drip of water from the north underdrain, but no drainage from the other underdrain <br />pipes or the black plastic pipe. Monitoring pipes were in place on the reclaimed slopes. <br />There were no stability problems with the reclaimed road. <br />The vegetative cover at the reclaimed coal stockpile was generally good, although a few spots had <br />sparse vegetative cover. The upper diversion ditch was well grassed and functional. <br />Records <br />The mine records are in the Delta County Courthouse and were incompliance. <br />c:/word/blueribbon/insp0905 <br />
