III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection, conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the inspection. The inspection took place in the early morning so that the Hubbard <br />Canyon road would be frozen and, therefore, passable. <br />Roads <br />The entrance gate was closed. The pond 5 access road was in good condition. <br />Signs and Mazkers <br />There is a new mine ID sign up on the entrance gate, with the new address for the operator. Surface <br />disturbance mazkers defined the disturbed azea. <br />Hydroloey <br />There was ice-covered water in pond 5, well below the discharge level. The pond spillways were <br />functional. The pond embankment appeared to be stable. Pond 4 was dry. The embankment was well <br />vegetated. Spillways were operational. <br />The main collection ditch leading to pond 5 was well vegetated and had ample capacity. The clean <br />water diversion ditch above the reclaimed coal stockpile area was also well vegetated and had <br />sufficient capacity. The culvert passing runoff from this azea under the road and to pond 4 was cleaz. <br />Reclamation <br />There was no evidence of slope instability or erosional gullying on the backfilled reclaimed slopes. <br />There was no water coming out of any of the underdrain pipes. <br />c:/word/blueribbon/insp 1105 <br />
