III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II-W Mine conducted on September 19, 2001 by <br />Mike Boulay of the DMG. Roy Karo of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were sunny and warm. Ground conditions were dry throughout <br />the majority of the site. <br />HydroloQic Balance <br />Site Ponds 005 and 006 were inspected. As noted during the last inspection, Pond 005 has <br />become inundated with sediment due to recent heavy rain and inflow to the pond. SCC is still in <br />the process of cleaning this pond out. To ensure compliance, remove the remaining sediment <br />from the pond and clean the sticks and debris from the trash rack. Pond 006 was full and <br />discharging clear water. <br />Stocktank T-23 located across Road G upstream from Pond 005 is also completely full of <br />sediment. Please clean this Stocktank out and repair the damage that has occurred to the rock <br />check dam at this location. <br />Water that is impounded in spoil material in the 006 Gulch is being pumped to the B Pit pre- <br />settling basin. Approximately 2-3 acre-feet of water has been removed from this location, since <br />the time of the last inspection. Please continue to pump the water from the impoundment and as <br />soon as practicable, begin backfill and grading operations at this location. <br />To soil <br />Spoi] failure into an undisturbed area has occurred along the eastern edge of the permit boundary <br />in TSN, R88W, Section 26 of the permit area. SCC informed DMG that this occurred on <br />September 13, 2001. The affected area is less than a tenth of an acre. After inspecting the area, <br />the DMG and SCC personnel concur that removing the topsoil from the site would create more <br />disturbance. Since the area in question is so small, the site should be left as is to allow the <br />location to stabilize. Because the failure occurred beyond the disturbance boundary, please <br />submit a minor revision to the permit document to extend the disturbance boundary to the east at <br />this location. <br />The eastern perimeter of the South Area pit at the location of NOV CV-2001-002 was inspected. <br />Rills and gullies that formed near the upper portion of the slide azea have been repaired and the <br />entire slide area has been seeded. The temporary road used to access the base of the slide area <br />has also been hand seeded. All mitigation measures have been successfully completed for the <br />abatement of NOV CV-2001-002. <br />
