III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG). The weather was warm and ground conditions were dry. <br />This mine has closed and reclamation of most areas is complete. I was unaccompanied on <br />this inspection. <br />Availability of Records <br />The mine records are kept at the EFCI office in Florence, 719-784-6395. All records were <br />found current and in compliance. Details of the records check can be found on page 2a of <br />this report. <br />Roads <br />The entrance road and road to the refuse disposal area was dry. The surface was slightly <br />rough but water bars were functional. Due to significant runoff this summer, this road would <br />benefit from reshaping and grading during dry conditions. <br />Hydrologic Balance <br />Both Pond 5 and Pond 4 were dry. Embankments and spillways appeared normal. Recent <br />runoff has not resulted in excessive down-cutting of the ditch into Pond 5. The Magpie <br />Creek Diversion ditch was in excellent condition. The two ponds at the former loadout were <br />also dry. <br />Topsoil <br />Topsoil piles saved for the small amount of remaining reclamation to be completed were <br />found appropriately marked and reasonably well vegetated. <br />Revegetation <br />As a result of the review of the 2003 Annual Reclamation Report, the Division determined <br />from review of the seed tags that the seed mix used in 2003 on approximately 13 acres of <br />the Corley property was not the seed mix approved as part of the reclamation plan. Two <br />introduced species (crested wheat grass and intermediate wheatgrass) were included while <br />two native species {beardless bluebunch wheatgrass and Indian ricegrass) were excluded <br />from the actual seed mix used. As a result of this finding, the Division issued NOV C-2004- <br />003. Visual inspection of the Corley property confirms that crested wheatgrass is present in <br />numbers that are noticeable. Inspection on the adjacent Vento property seeded in 2003 <br />indicated that crested wheat grass was not present to any significant degree. <br />Vegetation on the reclaimed areas has dried-down due to the approach of the end of the <br />
