(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1987-028 <br />INSPECTION DATE 05/19/06 INSPECTOR'S INITIALS ESC <br />OBSSRVATION3 <br />This was a preoperation inspection of the Lilly Mines conducted by Erica Crosby and Allen <br />Sorenson of the Colorado Division of Minerals and Geology. Chris Welker and John Newbert of <br />the US Forest Service accompanied the inspection. Ken Klco, the agent for Colorado Marble, <br />was present during the inspection. <br />The Lilly Mine is located 1 15 miles north of Garfield in Chaffee County, Colorado. The site <br />is situated at an elevation of 11,000 feet. The permit was issued on March 18, 1988 for 9 <br />acres of disturbance. During the Division's inspection of September 28, 2004, it was noted <br />that the operator was mining outside of the approved permit boundary and the Division <br />required the operator to submit a Conversion Application (CN-O1). CN-O1 was submitted on <br />January 12, 2006 to address the areas outside the permit area, and add new acreage for future <br />mining development. The operator proposes a new permit area in the amount of 72 acres in <br />size. <br />The purpose of the visit was to do a pre-operation inspection of the site in accordance with <br />Rule 3.2(7) of the Construction Materials Rules and Regulations. Representatives of the US <br />Forest Service accompanied the inspection in accordance the Memorandum of Understanding <br />signed in May 2004. According to the recent survey conducted by the operator, approximately <br />22 acres of the existing and amended site will be located within San Isabel National Forest. <br />The Division currently holds a financial warranty in the amount of $282,000.00.00 <br />Staging Area/Access Road <br />The DMG and USFS met at the staging area off of FR 228 and Hwy 50. The USFS stated that the <br />staging area is located on USFS lands, and legal right of entry has not yet been granted. In <br />the Division's adequacy letter of April 25, 2006 the Division notes that the operator states <br />that a lease agreement from the Nevana Family will need to be obtained for use of the staging <br />area parcel as a temporary stockpile for the end of season use. However, in another section <br />of the application, the operator provided the Lilly Mill site claim that was added to the <br />Exhibit Ca. This issue will need to be clarified by the operator. The USFS also is <br />requiring that the operator obtain a 7700 Engineering Road permit in order to use the road <br />for hauling purposes. If the applicant plans to upgrade or modify Road 228 as a result of the <br />mining operation, Rule 6.3.3 (g) requires the applicant to specify the existing or proposed <br />roads that will be used for the mining operation. Any improvements necessary on existing <br />roads and the specifications to be used in the construction of the new roads needs to be <br />described in the permit and included as part of the permitted acreage. The applicant will <br />also need to address reclamation of any new or improved roads constructed on site. The <br />application will need to be amended to include the road, where as the public comment period <br />will begin anew. <br />Waste Pile <br />The waste pile area was inspected. A portion of the pile was expanded to the south in 2005. <br />Existing elopes on the waste pile were measured, and appeared to be 1.25h:1v. The operator <br />proposes to reclaim waste pile slopes to 3h:ly. In some cases, the waste pile toe extends in <br />close proximity to Taylor Gulch and may need to be pulled back into the lower pit area. <br />Trees have been cut down, but very little vegetation and topsoil removal was noted. Any <br />future waste pile development must take into account proper construction techniques like <br />removing vegetation and salvaging of topsoil. Waste pile construction issues are noted in <br />the Division's geotechnical letter dated June 1, 2006. <br />Canadian thistle, a state listed noxious weed, was noted along the base of the waste pile. <br />The operator will need to control the presence of this noxious weed in accordance with the <br />weed management plan. Documentation in the form of photographs or receipts will need to be <br />submitted to the Division on or before July 19, 2006. See page 4 for additional information. <br />Silt fences were noted at the base of the waste pile, where small drainages lead into Taylor <br />Gulch. The silt fences were keyed in place and appear to be functioning properly. In some <br />areas, the silt fences were over '/, full of sediment and will need to be cleaned. <br />Documentation in the form of photographs or receipts of silt fence maintenance will need to <br />be submitted to the Division on or before July 19, 2006.
