Cattany <br />Division Director <br />/ . / Natural Resource Trustee <br />~ v v <br />Re: Hertzog Pit, M-1981-276, Notice of Failure to Correct Noted Problem from Inspection on <br />September 14"', 2005. <br />Dear Mr. Hertzog: <br />On September 19`h, 2005 Division of Minerals and Geology sent Hertzog Trucking an inspection report <br />for the above referenced permitted site. A problem was noted with the way oils and other petroleum <br />products were stored or disposed of on site. The report asked for pictures documenting the clean up of <br />empty buckets and barrels and the proper secondary containment for products stored on site. A <br />correction date of October 10th, 2005 was noted. Staff has given Hertzog an additional 30 days for a <br />response and has received none. Therefore, staff is informing Hertzog Trucking that if the requested <br />pictures of corrections are not received by December 20th, 2005 the problem will be changed to a Notice <br />of Violation and scheduled for the next available Mined Land Reclamation Board Hearing. If <br />scheduled, Hertzog faces possible civil penalties, permit revocation and / or bond forfeiture.
