Enforcement <br />actions resulting from failure to comply with the Act, r2ules an P.eyulations, and the permit <br />also are identified beloce. <br />Hydrologic Balance (4.05) <br />The mine pit is experiencing a large inflow of water from the tratum directly above <br />the coal seam and from the coal seam. The water is impounded i a sump and pumped daily <br />to the recently completed pond C. It is possib-le that the Ovate being pumped into pond <br />C is returning directly into the pit via percolation. In oz'de to confirm this hypothesis <br />the operator decided to pump the water from pond C into ~ifann Dr w. [9a ter quality samples <br />were taken when the pumping started and weze to be taken just 6-fore pumping ceased, Sampling <br />of the water is commendable, however, the Division was not info med of this action nor was <br />this operation specifically approved. Water pumped at high pre sure into Fiann Draw without <br />adequate Frotection could cause severe erosion. (See Section I of this report) <br />Backfillin9 and Grading (9.19) <br />Potential postmining topography drainage problems exist adjacen to the east dump. Due east <br />of point 32 a pond has formed on undisturbed~larrd. Control poi is on the undisturbed area <br />were not close enough to detect that a depression of 1 to 2-fee deep, 40 foot in diameter <br />would be formed on the reclaimed surface. (See Section IV of t is report) <br />Support Facilities Not Located at the Mine Site (9.28) <br />Topsoil removal operations were underway at the Northyate loado~t during this inspection. <br />(See Section IV of this report) <br />
