~ r. <br />MINE ID # OR PROSPECTING ID #: M-~ ag~-nna <br />INSPECTION DATE: s-»-n~ INSPECTOR'S INITIALS: RK <br />The Division conducted a monitoring inspection of the site at the request of the operator. The site is a 32- <br />acre, 112 sand and gravel operation located in the old town of Gillette, Colorado. Since the permit was <br />issued, in 1992, the site is mined, only on as need basis, and the maximum disturbed area does not exceed <br />1 acre. The site is now in Temporary cessation. The operator has been trying to get another operator to <br />mine the property but was unable to secure an agreement. <br />Recently, the operator contacted the Division and informed, of their intention to commence operation. <br />A small perennial stream flows along the North East portion of the permit area, according to the operator, <br />that was not the natural channel, it was re-aligned by an adjacent operator of a 110 permit, and allowed <br />the flow to go over their property. According to the operator, the re-located channel created a considerable <br />amount of wet lands in excess of the .8 acres, that was present, when the permit was issued, in the existing <br />permit area and wants to relocate the stream, to its original channel prior to commencing the operation. <br />Since both the 110, and 112 permits are located in the head waters of the stream, and the original mining <br />plan, did not include mining in wet land areas, It will be up to the Army Corps to determine the out come. <br />The Division does not have jurisdiction over wet lands, and re-location of channels, the operator is <br />encouraged to contact the Army Corps of engineer. <br />The entire site was walked and inspected, as reported in previous inspections, very little disturbance <br />associated with mining had taken place since the permit was issued. A considerable amount of wet lands, <br />which appeared to be in excess of .8 acres, not actually measured were noted with in the Permit area. <br />Permit Sign is a bit faded and could use a new sign, once the operation commences. Some of the permit <br />boundary markers, that are not natural features could also use, added maintenance.
