III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground mine was reclaimed and reseeded in <br />1996 and early 1997. The mine has achieved a Phase II bond release for the <br />majority of the disturbed area. The ground was partial snow-covered and muddy in <br />places. The weather was breezy and mild for December. <br />Excess Spoil and Development Waste <br />The development waste pile is located on the eastern edge of the main area of <br />reclamation at the site. The pile is a side hill configuration and has been <br />certified as constructed in accordance with the approved plan by a register <br />professional engineer. The structure is no longer required to be quarterly <br />inspected by the operator. Drainage is diverted from above the pile by a small <br />ditch on the west side. This drainage continues around the north side of the pile <br />until it reaches the lower eastern toe where it passes through a culvert under the <br />railroad tracks and access road. Some siltation on the north section of this <br />ditch below the steeper section should be removed to ensure drainage stays within <br />the ditch. Vegetation, although seasonally dormant, is relatively good in most <br />areas of the pile. No sign of slumping or instability was observed. Longer <br />reaches of slope show little sign of rilling or channeling of surface runoff. <br />Overall, the site appeared in normal condition for the early winter season. No <br />problems were found. <br />3 <br />
