• (Page 2) • <br />MINE ID # OR PROSPECTING ID # M-99-120 <br />INSPECTION DATE 02/01/00 INSPECTOR'S INITIALS ESC <br />OBSERVATIONS <br />This was a pre-operation inspection of the Ft. Lupton Sand and Gravel Mine conducted by Erica <br />Crosby of the Colorado Division of Minerals and Geology. Rick Everist and Lynn Mayor of L.G. <br />Everist were present during the inspection. Weather conditions on site were clear and cool. <br />Ground conditions were dry. <br />L.G. Everist, Inc. filed a complete 112 Construction Materials Application with the Division <br />on December 27, 1999. The applicant proposes to mine sand and gravel from an 85-acre permit <br />area. The Division's decision due date is set for March 27, 20000. <br />The mine site is located approximately 2 miles northwest of the Town of Ft. Lupton in Weld <br />County, Colorado. The site is west of the South Platte River. Surface and mineral ownership <br />is privately owned by L.G. Everist, Inc. Amine notification sign was posted at the entrance <br />to the site from County Road 18, identifying the filing of a new application. The existing <br />fence line marks the permit boundary. <br />It appears that all structures within 200 feet of the affected area are identified on the <br />Pre-Mining and Mining Plan Map (Exhibit C). Such structures include houses & outbuildings, <br />alluvial wells (5), oil/gas wells (2), pipelines (on the western part of the site and <br />traversing through the property), overhead utility lines, irrigation ditches and fences. The <br />applicant intends to directly affect a number of structures during the mining activity <br />including the houses and outbuildings, Lupton Bottom Ditch, overhead utility lines, and <br />underground pipelines. The permit application is not clear as to the owners of the <br />structures noted above because not all of the owner's of the said structures were identified <br />in the permit application. All owners of structures within 200 feet of the affected area <br />must be included in the application (Rule 6.4.3(g)). The Division is currently reviewing the <br />application regarding structures located on the affected land and within 200 feet of the <br />affected land. <br />The proposed postmining land use is developed water resource. The applicant will construct <br />a slurry wall 30 feet in from the permit boundary. The slurry wall will be constructed prior <br />to mining and exposure of groundwater. In addition, the Lupton bottom Ditch, the pipeline <br />to the oil well, overhead utility lines and an access road will be reconstructed once the <br />area has been mined. The operator stated that they are currently working on the necessary <br />agreements to move/relocate the structures. <br />Issues discussed during the inspection were structures located within 200 feet of the <br />affected are (owners of the structures and compliance with Rule 6.4.19), designs for the <br />slurrywall and compacted berm, impact to adjacent wells and a 100-year floodplain analysis. <br />All of these issues will be addressed in the Division's adequacy review letter. <br />I & E Contact Address <br /> ^ CE <br />NAME Rick Everist ^ BL <br />OPERATOR L.G.
