III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on December 6 and 7, 2006 by <br />Mike Boulay of the DRMS. Roy Kazo of Seneca Coal Company (SCC) was present during the <br />entire inspection. Weather conditions were sunny and cold. Ground conditions at the mine site <br />were mostly snow covered. There was no activity at the mine site at the time of the inspection. <br />Availability of Records <br />All required records were on file and available for review at the Yoast Mine office. Please see <br />the attached records checklist at the end of this inspection report. The public copy of the permit <br />application and revisions were inspected at the Hayden Public Library. All required information <br />was on file at the library and accessible to the public. <br />Roads <br />Only a small portion of the site was accessible due to snow packed road conditions. Haul Roads <br />A and B and the county road leading to Ponds 012, 013, and 014 were accessible. Road drainage <br />run outs, berms and ditches along Haul Roads A and B were mostly snow covered. Haul Roads <br />A and B were maintained and in good condition. The site was only accessible up to the dragline <br />teardown azea. <br />Hvdrologic Balance <br />Sedimentation Pond 010 was viewed from Haul Road B. Pond 010 was snow covered and <br />appeazed to be holding a significant amount of water. Ponds 012, 013, and 014 were viewed. <br />Ponds 012 and 013 were discharging. Embankments, inlets, and discharge sturctures were stable <br />at all of these pond locations. The road leading to Pond 011 was inaccessible due to heavy snow. <br />Explosives <br />The ATFE Explosive Permit expired for the Seneca complex in July 2006. According to SCC, <br />the permit will be renewed. The explosives storage azea was inspected. The two ANFO silos <br />will be removed, but the two storage magazines will remain at the site. A lazge amount of rock <br />for channel construction is being stockpiled north of the explosive storage area. <br />Slides and Damnase <br />The site of the slide above Pond 012 was viewed from the Pond 012 embankment. There is new <br />movement evident in the slide damaged area. There is two-three feet of displacement in the <br />crack located on the hillside above the pond. Anew mitigation plan for the slide damaged area <br />may be needed to ensure the integrity of Pond 012. SCC will continue to monitor the slide and <br />make repairs as needed. <br />
