III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussions of observations made during The <br />inspection. Comments in Section IV describe any enforcement actions Taken during the inspection and the facts <br />or evidence supporting the enforcement action. <br />Concerns carried over from previous inspections: none. <br />Signs and Markers The only sign at the site is a Division reclamation identification sign. <br />It is in good repair. <br />Hydroloctic Balance There was no surface runoff apparent at the site. There was no <br />water in the sedimentation pond. <br />Revegetation Overall, the site was dry but vegetation looked good. <br />Slides and Damage Deposition of sediment by erosion of the upper coal mine waste <br />development pile into the roadside ditch appeared to be no greater than that under <br />adjacent roadside cut embankments. <br />Other A telephone report of a fire at the mine had been received by the Division <br />(telephone call from Steve Renner, IMP). Mr. Renner responded on August 29, 2003, <br />and examined the site. No smoke was seen during this inspection; however, the site <br />as described by Mr. Renner was observed, The area that appeared to be over <br />underground fires (dry and dead vegetation) was located on a ridge, above the <br />Upper Sandstone of the Bowie Shale Member, Williams Fork Formation, Mesa Verde <br />Group, some 800 (stratigraphic) feet above the "D" seam mined at the Sunlight Mine. <br />This would be close to the Sunshine Coal seam. As Mr. Renner described, there was a <br />coal mine waste pile below County Road 117 (Fourmile Road) directly below the site. <br />The site was estimated at 2000 feet horizontal distance upstream from the Sunlight <br />Mine portals, near the west edge of the permit area. <br />C-8T-046, Page _3_ of _4_ Pages, (date) _8 September 2003, (initials) _BGW <br />
