*. _. ~ ~II II~~I~II~I~I~ II~ To: Gary Curtis, Inspector Colorado Division of Minerals 6 Geology 1313 Sherman Street, Room 2I5 Denver, Colorado 80203 Dear Gary Curtis, November 16, 1995 ~f ~~~~ NOV 2' _,~ /1Y1&lOfl p1 lYIIIiBI6iL v latlUiV~Y Hy name is George Stepanof, I own a home at 436 Pearls Pl in Fairplay, CO, I am very concerned about the iti.ning operations that are taking place directly across the river frog my property at M-83-084, I am recently retired, but prior to retirement I was in charge of the Hazardous Materials Smergenty Response Team for the City of San Diego, i vas also a member of the Local 8mergency Planning Committee [LEPC] appointed by the Govenor for the State of California Aegion 6, I was also past chairman for the San Diego County Hazardous Materials Advisory Committee. After reviewing a recent Inspection Report for M-83-084 dated 9/28/95, I would like to lodge a complaint, My Concerns are: 1. The apparant disregard to stay within the perimeters of the permit. 2, The allarable size of the active pit is 2.1 acres. He has illegally increased the size to approximately 6 acres, 3, No approved sediment pond in permit, 4, The Pit and Settling ponds have been enlarged illegally without an approved permit, This will increase reclaimation costs, 5, Soil contamination from wasteoil and feel storage tanks without spill containment structures. 6, The Diesel Generator situated right on the edge of the river that pumps water out of the Middle Fork of the Sonth Platt River. This pump and generator has already contaminated the soil on the rivers edge and has certainly polluted the river, 7, Not in compliance vith the Cleanwater Act in reference to the discharginq~,of storm water, My main concerns are as I sit looking out of my living room window, overlooking this beautiful valley with the river running through it is this diesel pump sitting right in the middle of my view. This pump is also very noisy. It is also polluting the river, My next concern is, with all the conditions presently out of compliance with the present operators permit will they still be able to continue to operate? Will there be enough ropey posted to crorrect all the damage being done to the property?
