<br />*. _. ~ <br /> <br />~II II~~I~II~I~I~ II~ <br />To: Gary Curtis, Inspector <br />Colorado Division of Minerals 6 Geology <br />1313 Sherman Street, Room 2I5 <br />Denver, Colorado 80203 <br />Dear Gary Curtis, <br /> <br />November 16, 1995 <br />~f ~~~~ <br />NOV 2' _,~ <br />/1Y1&lOfl p1 lYIIIiBI6iL v latlUiV~Y <br />Hy name is George Stepanof, I own a home at 436 Pearls Pl in Fairplay, CO, <br />I am very concerned about the iti.ning operations that are taking place <br />directly across the river frog my property at M-83-084, <br />I am recently retired, but prior to retirement I was in charge of the <br />Hazardous Materials Smergenty Response Team for the City of San Diego, <br />i vas also a member of the Local 8mergency Planning Committee [LEPC] appointed <br />by the Govenor for the State of California Aegion 6, I was also past chairman <br />for the San Diego County Hazardous Materials Advisory Committee. <br />After reviewing a recent Inspection Report for M-83-084 dated 9/28/95, <br />I would like to lodge a complaint, <br />My Concerns are: <br />1. The apparant disregard to stay within the perimeters of the permit. <br />2, The allarable size of the active pit is 2.1 acres. He has illegally <br />increased the size to approximately 6 acres, <br />3, No approved sediment pond in permit, <br />4, The Pit and Settling ponds have been enlarged illegally without an <br />approved permit, This will increase reclaimation costs, <br />5, Soil contamination from wasteoil and feel storage tanks without <br />spill containment structures. <br />6, The Diesel Generator situated right on the edge of the river that <br />pumps water out of the Middle Fork of the Sonth Platt River. This <br />pump and generator has already contaminated the soil on the rivers <br />edge and has certainly polluted the river, <br />7, Not in compliance vith the Cleanwater Act in reference to the <br />discharginq~,of storm water, <br />My main concerns are as I sit looking out of my living room window, overlooking <br />this beautiful valley with the river running through it is this diesel pump <br />sitting right in the middle of my view. This pump is also very noisy. It is <br />also polluting the river, <br />My next concern is, with all the conditions presently out of compliance with <br />the present operators permit will they still be able to continue to operate? <br />Will there be enough ropey posted to crorrect all the damage being done to <br />the property? <br />
