III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete quarterly inspection conducted by Dan Mathews of the DRMS Grand Junction Field Office. <br />The primary inspection was conducted on 5/23, in the accompaniment of Henry Austin of the Office of Surface <br />Mining Reclamation and Enforcement (OSM). A short follow-up inspection was conducted on the morning of <br />5/24, in the accompaniment of Mr. Austin, as well as Bruce Fowler of the Bureau of Land Management Grand <br />Junction Field Office (BLM). Gary Isaac, CAM mine manager saw Henry and me the Loma Loadout site and <br />made contact with us prior to initiation of the inspection. The purpose of the primary inspection was a complete <br />OSM oversight inspection of the Munger Canyon Mine and reclaimed Loma Loadout. Purpose of the follow-up <br />inspection was to assess and clarify certain aspects of the portal bench reclamation plan with the operator and <br />BLM. Reclamation contractor (Kiewit Western) had mobilized to the mine site earlier in the week and preliminary <br />reclamation activity had been initiated. Jim Stover, engineering/reclamation consultant to CAM was present <br />during the inspection on 5/24, along with Scott Harr, field foreman for Kiewit. Contact was also made during the <br />inspection with Mark Miller, the over-all project supervisor for Kiewit. Kiewit plans to complete the scheduled <br />reclamation work (including reclamation of the portal bench, upper road, and waste disposal area) by June 15, <br />2007. <br />Inspection began at the Loma Loadout at 09:36 on Wednesday morning. The mine site portion of the inspection <br />was initiated at approximately 11:30 on Wednesday morning, with the short follow-up inspection at 08:30 on <br />Thursday morning. Weather was partly cloudy and cool on Wednesday, clear and mild on Thursday. Ground <br />conditions were moist to relatively dry, depending on location. There has been no significant precipitation <br />recently. There was flow in East Salt Creek but no flow in Munger Creek. <br />The Division's proposed decision to approve the technical revision application addressing various updates to the <br />reclamation plan (TR-22), was issued on May 23. The decision will become final 10 days after publication in the <br />Grand Junction Daily Sentinel, if there are no objections to the proposed decision. CAM plans to permit a small <br />coal waste disposal site at McClave Canyon Mine to replace the Munger coal waste disposal site, which will be <br />reclaimed during the current reclamation project, under the reclamation schedule as amended by TR-22. CAM's <br />right of entry along the existing Munger Canyon road has been the subject of a legal dispute with #11 <br />Resources, landowner along the lower segment of the road. The dispute was recently resolved, and CAM <br />reached agreement with #11 Resources to retain access along the road through #11 Resources property, as <br />necessary to perform reclamation, monitoring, and maintenance activity required by permit and regulations, until <br />final bond release. <br />Availability of Records <br />Required records were on file and up to date through the 1 st quarter, 2007, with the exception of the most <br />recently issued DRMS permit document and associated Renewal Findings, and most recent Insurance <br />Certificate Renewal. These documents will be copied and inserted into the "Mine Records Books" by the <br />Division during the next site inspection. <br />Signs and Markers <br />The sign with DRMS address and phone number at Loma Loadout has become detached from the stake <br />and needs to be re-secured. <br />3 <br />
