III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />small amount of water. Small amounts of the ROM coal continue to <br />be shipped out whenever conditions allow. <br />The refuse disposal area (RDA) was carefully inspected and no <br />problems were noted. The 100-yr diversion was walked and found to <br />be in excellent condition. The sediment pond was cleaned out <br />earlier this fall and this effort has greatly increased its <br />capacity. The pond was holding a very small amount of water well <br />below discharge level. <br />The pile is nearing its design capacity and the operator is <br />planning to implement the previously approved expansion next year. <br />The top of the pile has been graded and is nearly ready to receive <br />the final cover. Areas that were reclaimed in 1994 have began to <br />establish decent vegetative cover. Unfortunately a considerable <br />amount of the cover is comprised of cheatgrass. This area will be <br />watched carefully and if desirable perennial vegetation does not <br />crowd out the cheatgrass, it may have to be reseeded. <br />The inspection continued at the coal loadout where the surge <br />stockpile is nearly gone. Sediment control measures were in place <br />and in good condition. There is a small low quality surge pile on <br />the coal storage bench one level above the loadout level. This <br />material is blended with the market coal whenever conditions allow. <br />The site inspection finished up at the upper fan level. The powder <br />and cap magazines and their associated small area exemption were <br />inspected and no problems were noted. The fan level upland <br />diversion received considerable maintenance earlier this year to <br />clean out debris and clearly re-establish positive drainage. This <br />work appears to have been successful. <br />The inspection concluded by examining records that are required to <br />be kept on file at the mine office. These records were found to be <br />complete and in compliance with Division requirements. A records <br />checklist detailing this review is attached to this report. <br />
