III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the
inspection and the facts or evidence supporting the enforcement action.
This was an complete inspection of the Rimrock Coal Mine for the month of August, 1996.
Records were inspected and the results of the inspection are noted on page 5 of this report. In
general the condition of the records are deplorable. It appears that no one from Landmark has
been to the courthouse to organize the files since the office was moved. Revisions have not
been posted and letters and pond inspections etc are jammed into the permit binders. Currently,
the insurance certificate has expired and previous DMG and OSM inspection reports could not
be found. It is not the responsibility of DMG nor Las Animas County personnel to do filing and
maintenance of the Rimrock Coal Mine records. If the records are not updated, and the missing
or outdated records replaced, as well as the revised permit pages replaced by the next complete
inspection, an NOV will be issued.
The site is in very good condition. The pond had only a trace amount of water and appears
capable of functioning as designed. Ditches are clear and stable. The vegetation at the site is
doing extremely well and some limited grazing may be benificial next summer. Erosion on site
was very minor despite some intense thunderstorms that have recently occured.
