<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was an complete inspection of the Rimrock Coal Mine for the month of August, 1996. <br />Records were inspected and the results of the inspection are noted on page 5 of this report. In <br />general the condition of the records are deplorable. It appears that no one from Landmark has <br />been to the courthouse to organize the files since the office was moved. Revisions have not <br />been posted and letters and pond inspections etc are jammed into the permit binders. Currently, <br />the insurance certificate has expired and previous DMG and OSM inspection reports could not <br />be found. It is not the responsibility of DMG nor Las Animas County personnel to do filing and <br />maintenance of the Rimrock Coal Mine records. If the records are not updated, and the missing <br />or outdated records replaced, as well as the revised permit pages replaced by the next complete <br />inspection, an NOV will be issued. <br />The site is in very good condition. The pond had only a trace amount of water and appears <br />capable of functioning as designed. Ditches are clear and stable. The vegetation at the site is <br />doing extremely well and some limited grazing may be benificial next summer. Erosion on site <br />was very minor despite some intense thunderstorms that have recently occured. <br />
