III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement aclions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (Division). A proposed decision to approve a Phase 111111 bond release <br />application (SL-05) submitted by Energy Fuels Mining Company (EFMC) was issued <br />effective December 9. 2005. The weather on the day of the inspection was extremely windy <br />but ground conditions were dry. <br />Availability of Records <br />The public copy of the mine records is kept at the office of the Las Animas County Clerk at <br />the county courthouse in Trinidad. All required records were easily located. Details of the <br />records inspection can be found on page 2a of this report. George Patterson of EFMC <br />provided me with copies of the 3'" quarter 2005 sediment pond inspection, RDA inspection, <br />and Discharge Monitoring Reports, These documents were returned to the Division office <br />and scanned into the permit imaging system. <br />Hydrologic Balance <br />No storm runoff has occurred since the last inspection. No changes were observed at the <br />recently modified permanent impoundment. The operator submitted a copy of the PE <br />certification of these changes to the Division via FAX on December 6, 2005. <br />Reclamation Success <br />The mine site has completed all reclamation work and barring any public comment, the site <br />will be fully released from all liability after 30 days from the first publication of the public <br />notice of the proposed decision to approve Bond Release No 5 (SL-051. <br />..- ff • . <br />9 ~~~i ~~ <br />N J <br />•• , <br /> <br /> <br />
