III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />the inspection and the facts or evidence supporting the enforcement action <br />extreme southwestern portion of the underground workings is located to the southwest of the structures. No <br />evidence of subsidence features was noted while inspecting this area (Mr. Austin's GPS N40°25 587, W 107° 40 <br />709). Surface topography overlying 6'" West panel consisted of the Twentymile Sandstone outcrop and cliff: <br />The inspection covered as much of this overlying area as possible. No surface expression of subsidence was <br />visible on lands overlying the 6`h West panel. <br />Two reclaimed drill pads (feature no. 21 and feature no. 22; no photos available) were noted in the NW '/<NE'/o <br />Section 36. No problems were noted with either drill pad. Both pads had been regraded to blend with <br />surrounding land, revegetated, and no hole, casing or trash left on the site. Mr. Barker pointed out a third drill <br />pad, feature no. 23 (no photo available), located at S W '/< S W '/4 Section 25,T6N, R92 W (Mr. Barker's GPS <br />reading N40°26'08.0" W 107°40'20.9"). This pad was partially vegetated. The center (approximately 25-foot <br />diameter circle) remains bare. <br />The inspection concluded at this point (3:OOpm on November 19, 2004). The party exited the way we entered, <br />securing gates as we exited. Since RAG-EC/BTU-Empire personnel did not accompany us onto Mr. Barker's <br />property, Sandra White with RAG-EC/BTU-Empire was notified by telephone when we left the mine site. <br />The Division is preparing an adequacy letter that will follow this report <br />Page -6_ of _~ 3_ Pages, (date) 12/07/04 , (initials) ihb <br />
