III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Seneca II-W Mine conducted on August 28 and August 30, <br />2001 by Mike Boulay of the DMG. Chuck McCulloh of Seneca Coal Company was present <br />during the entire inspection. Weather conditions were cloudy and warm. Ground conditions <br />were dry throughout the majority of the site. <br />Hydroloeic Balance <br />Site Ponds 005, 006, 009, 015, and 016 were inspected. All sedimentation ponds were full. Only <br />Pond 005 was dischazging at the time of the inspection. Due to recent heavy rain, Pond 005 has <br />been inundated with sediment. The sediment level in this pond is nearly to the level of the <br />primary spillway. SCC has built a bench on the north side of the pond, so that equipment can <br />access the pond for cleaning. The trash rack at Pond 006 needs to be cleaned out. The recent <br />inflow to the pond has clogged the trash rack with sticks and debris. An accumulation of mud <br />and sticks was also noted neaz the inlet side of Pond 016. Please conduct [he necessary cleaning <br />and maintenance of these ponds to ensure that they function properly. <br />A small crack approximately 6 inches wide has formed along the top of the embankment at Pond <br />016. The crack runs along [he entire length of the embankment. Please monitor this and make <br />repairs if necessary to ensure the stability of the embankment. <br />Check dams along the north side of Haul Road A located west of Pond 006 have been damaged <br />due to the heavy runoff. Please repair the check dams along this portion of the road ditch. <br />A significant quantity of surface water is impounded in the 006 Gulch located north of Haul <br />Road C and east of the B Pit pre-settling basin. The impounded water is located in spoil material <br />from the A Pit, and is within the disturbed area boundary. Spoil material has been pushed across <br />the 006 Gulch. The spoil material has been used to form an embankment, which has effectively <br />impounded approximately 2-3 acre-fee[ of water. It appears [hat the west side of the <br />dam/embankment has been accessed for the purpose of pumping water from the impoundment. <br />Please continue to remove the water from the impoundment and discharge it to either the B Pit <br />pre-settling basin or Pond 006. <br />Backfill & Gradine <br />SCC has committed to mining the remaining portion of the B Pit in 2001 and mining has been <br />completed in the A Pit. As soon as practicable, backfill and grading operations should begin at <br />these locations. <br />
