III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken durng the inspection <br />and the facts or evidence supporting the enforcement action. <br />This inspection was.an aerial inspection flown on August 18, 2003. There were no <br />problems with compliance that were observed during the overflight. The digital images <br />were reviewed on August 25, 2003. <br />East Mine <br />The paved main haul road was in good condition. The dirt access road up to the portal <br />bench was also in good condition. The light use road up to the fan azea and the light use <br />roads to the West Ridge waste pile pond and ponds 1 through 4 appeazed to be passable. <br />There has not been any recent reclamation activities at the East Mine. Most of the <br />facilities demolition has been done. A lot of concrete has to be broken up and buried in <br />place or moved closer to the highwalls for burial. There is a fair amount of machinery <br />and other mining equipment that needs to be removed and salvaged. <br />There were no erosional problems at the West Ridge waste pile or at the reclaimed old <br />waste pile. There was no evidence of slope instability at either waste pile. <br />There appeared to be a little water in Pond 1 but Ponds 2, 3, 4 and the West Ridge waste <br />pile ponds were all dry. <br />There were no signs of slope instability with any of the cut and fill slopes at the site. <br />There was a good stand of vegetation on the reclaimed areas, although the vegetation was <br />starting to turn brown. <br />Run-of--Mine (ROM) Stockpile <br />The pond at the ROM pile was dry. The pond embankment appeazed to be stable. The <br />collection ditch that leads into the south end of the pond appeared to be functional. <br />There did not appeaz to be any ponded water on the ROM pile. There is some mine <br />machinery being stored at the site. The haul road was in good condition. <br />West Mine <br />There were no erosional gullying at the West Mine fan azea. The road to the fan area <br />appeazed to be passable. The vegetation on the topsoil stockpile is fuming brown but the <br />vegetative cover is excellent. <br />
