III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II Mine conducted on June 21, 2006 by Mike Boulay <br />of the DMG. Dennis Jones of Seneca Coal Company (SCC) was present during the entire <br />inspection. Weather conditions were sunny and warm with a few clouds. Ground conditions <br />were dry throughout the majority of the site. There was no activity at the mine site during the <br />inspection. <br />Hydroloeic Balance <br />Sedimentation Ponds 004 and 008 were inspected. Both Ponds were discharging clear water. <br />Pond 004 was discharging at approximately 50 gpm and Pond 008 was dischazging at about 60 <br />gpm. The trash rack at Pond 008 was clogged with algae, because of the type of trash utilized; <br />this may continue to be problematic. A different type of trash rack such as a cage inserted over <br />the end of the discharge pipe may be prevent this problem in the future. No other problems were <br />identified at either of these pond locations. <br />Backfillinti and Grading <br />Major features shown on the 2006 Rill and Gully Survey prepared by SCC were inspected. <br />Spring runoff caused significant erosion and the reformation of several gullies on the south- <br />facing slope at the lower end of the former East Wadge pit. The gullies were repaired and the <br />eroded areas were roughened and broadcast seeded in previous years. Several of these gullies are <br />shown on the 2006 Rill and Gully Survey. One significant gully located above the access road <br />and west of Post-Mine Channel PM-8 is not shown on the survey. These gullies in the lower end <br />of the East Wadge pit area appear to prohibit successful revegetation and should be regraded or <br />stabilized and reseeded. <br />The azea indicated as "Out Of Drainage" on the Rill and Gully Survey is located along Post Mine <br />Channel PM-11. There is a spoil spring at this location and it is not associated with PM-11. As <br />verified by Dennis Jones of SCC this has been documented as Spoils Spring #2 and is included in <br />the hydrology-monitoring program. <br />Another area of concern is the Slide Area shown on the Rill and Gully Survey south of the <br />PECOCO Pond. As shown in the attached pictures a seep is evident in the same general vicinity <br />of the slide and in the recent past a deep hole/fissure has been repaired in the Post Mine Channel <br />PM-23 (seen as a dark area in the center picture). These features appear to be associated with the <br />location of the former highwall and groundwater discharge from the highwall may have caused <br />the slide. A mitigation plan should be developed and implemented to repair the slide and prevent <br />further slumping in this location. <br />
