<br />Page 37 <br />Construction Materials Rule 1 <br />(1) there aze no personnel working at the site for one hundred <br />eighty (180) consecutive days; <br />(2) there are only security personnel at the site; <br />(3) there are personnel other than security people at the site, but <br />they aze engaged in activities which can be described as maintenance or <br />housekeeping, or related activity; <br />(4) there aze personnel at the site, but they aze engaged in activities <br />which are not significantly moving the site towazds completion of the mining <br />operation. The Board will judge these activities in relation to the size of the <br />operation, the nature of the deposit and other facts; <br />(5) there is no sale oc processing of material or movement of <br />stockpiled material; <br />(6) there is only minimal or token excavation of construction <br />material or other material; or <br />(7) mine development has ceased and mining has not recommenced. <br />1.13.3 Indications Against Temporary Cessation <br />to3(11) (1) Extraction of construction materials has been completed and only <br />fmal reclamation and related activities occurring at the site are part of the "life <br />of the mine" (see Defmition or see Section 34-3"_'.5-103 (11), C.R.S.); or <br />(2) a permit has been issued, but the mining operation has not <br />commenced. <br />1.13.4 Temporary Cessation for a Portion of a Mining Operation <br />There may be Temporary Cessation for part of the mining operation when one <br />or more operations of several sepazable types within a permit has been <br />discontinued. Movement of portable equipment between permitted sites shall <br />not be construed to be Temporary Cessation. <br />
