III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach, Byron Walker, and Dan Hernandez of <br />DRMS. The operator was represented by Henry Barbe of Mountain Coal Company and Joe Frank of <br />HydroGeo, Inc. Willy Kistler of Minnesota Canal and Reservoir Company, Inc. also participated in the <br />inspection. The main objective of the inspection was to examine the Deep Creek drainage where the <br />operator anticipates extending underground mine workings in a fixture permit revision. The inspection <br />route followed Forest Service Road 711 through Section 2-14S-90W and included walks along the <br />Deep Creek irrigation diversion ditch in Section 11 and along Deep Creek in NE '/< Section 2. The <br />depth to E-seam mine workings throughout this area would be more than 1200 ft. <br />The ground was dry. With the operator's consent, this report was issued from the Denver office of <br />DRMS. <br />Signs and Markers <br />A topsoil marker was properly displayed at the Deer Creek shaft pad. Affected area boundary markers <br />were properly displayed at the corrals staging/laydown area, but are needed at the recently completed <br />Deer Creek shafr pad. Amine i.d. sign was properly displayed at the corrals staging/laydown area <br />where a public road enters the permit area. A mine i.d. sign is needed on Forest Service Road 711 in <br />NW '/< Section 2-14S-90W where the permit boundary was recently extended in PR-10. <br />Hvdrolo¢ic Balance <br />Upper and Middle Dry Fork flumes were dty and were in good repair. The wellheads of monitoring <br />wells SOM 3B, SOM-3E, and 96-2-2 were in good condition. <br />Flow in Deep Creek appeared less than 2 cfs upstream from Deep Creek Crossing in SE '/4 Section 2. <br />The Deep Creek irrigation diversion ditch was not carrying water during the inspection (see Photo 1). <br />The ditch carries water to Minnesota Reservoir that has been diverted from the Little Gunnison Basin. <br />The ditch crosses Deep Creek in an elevated steel flume (Photo 2), but does not divert water from Deep <br />Creek. The flume flows into a concrete collection box (Photo 3). <br />Two ground water seeps were found along the trail that extends through Section 12 that should be <br />added to the operator's baseline monitoring. An orange-colored (oxide?) seep was found in a side <br />tribuatary channel of Deep Creek that should be documented as a baseline condition (Photo 4). <br />3 <br />
