III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Mark Milner represented the operator. The mine site was somewhat wet from a recent <br />snowmelt. The operator is in the process of drilling the second of three methane degas wells. <br />Elk Creek <br />Construction work continues on the new Elk Creek facilities. The upper bench Elk Creek culvert <br />has been laid in place. There is only one section of Elk Creek culvert left to lay in place at the <br />lower bench. Additional silt fence should be placed near the outlet of the upper bench Elk Creek <br />culvert. Elk Creek water is flowing through the newly installed culvert but the Elk Creek <br />collection dam has not been taken down yet. <br />Topsoil is still being salvaged from Elk Creek and tracked to the Elk Creek facilities topsoil <br />stockpile. In addition, the operator is nearing completion in moving the topsoil from the lower <br />Elk Creek stockpile location to the upper Elk Creek location stockpile. Once all of the topsoil has <br />been salvaged, the operator can begin building up the two Elk Creek benches, using material <br />from the slope stabilization area. <br />West Vallev Fill <br />The lower lift outslope has been seeded and covered with coconut blankets. The refuse pile is <br />into its second lift. The west riprapped drainage ditch was functional. The east riprapped ditch is <br />closed at the upper end due to an MSHA-required berm. This berm will not be needed when the <br />road is reoriented later, so the top of the east ditch can be opened up at that time. The refuse pile <br />has positive drainage, although the east side of the refuse pile could use additional buildup of <br />refuse material. <br />Pond C was dry.
