III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />Coal Waste Disposal Stockpile Area <br />The gob pile haul road was in good condition, although the road became a little muddy later in the day <br />neaz gob pile no. 2. The outside berm was up and the road ditches had sufficient capacity. Pond C had <br />been recently cleaned out. There was a moderate amount of standing water in the pond, just above the <br />primary invert. A similar level of standing water was present in Pond D. Pond spillways were <br />functional. Culverts and ditches were operational as well. Topsoil stockpile signs were up and straw <br />bales were in place. There were no signs of erosional gullying on the topsoil stockpiles. No problems <br />were observed at the material storage area. <br />There have been no changes at gob pile no. 1 since the last inspection. The upland diversion ditch was <br />functional. At gob pile no. 2, the operator was spreading out coal waste for drying. The top of the pile <br />was wet but there was no standing water. The gob pile terraces also did not have any standing water on <br />them. There were no signs of erosional gullying or slope instability on the gob pile outslopes. The <br />upland diversion ditch had sufficient capacity and the two underdrains were exposed in the back of the <br />pile, as designed. The coverfill stockpile just to the east of gob pile no. 2 was also stable. There was <br />about one to two feet of standing water in Pond F. The primary discharge pump was in place. The <br />operator has approval to construct a new emergency spillway for Pond F that will take the emergency <br />discharge water over the Fire Mountain Canal. The project has not been started yet. <br />Unit Train Loadout <br />There were only three empty railcazs at the unit train Loadout. No problems were noted with any of the <br />loading facilities and there was no evidence of offsite fugitive dust. The Loadout bench outslopes were <br />stable. Sediment control structures were in place and functional. Ditches and culverts were clear. Pond <br />J and pond K did not have any standing water in them. Pond embankments appeared to be stable and <br />pond spillways were functional. There were no erosional problems at the main topsoil stockpile. <br />Topsoil signs, mine ID signs and surface disturbance markers were up. <br />Records <br />As documented on the attached records checklist, the records were in compliance. <br />c:/word/bowie2/insp 1105 <br />
