<br />r <br />(Page 21 <br />MINE ID # OR PROSPECTING ID # M-97-089 <br />INSPECTION DATE 5/78/99 INSPECTOR'S INITIALS JIV~IE <br />OBSERVATIONS <br />This inspection occurred in response to a written complaint submitted on 5/13/99 from the Friends of South <br />Montezuma Valley, Inc., dated 5/13/99, alleging that the operator is not following the approved mining and <br />reclamation plans. DMG responded to the complaint within the standard 30 day response policy. <br />Operations were active during the time of this inspection. DMG staff did not observe any problems or possible <br />violations of permit conditions, the Act and Rules. DMG holds 517,232 financial warranty. <br />Allegation of non-compliance with the approved mine plan On 5/12/99, DMG approved Technical Revision <br />#1 (TR-01) to the Stone Gravel Pit permit. TR-O1 modified the sequence and configuration of the mining <br />phases from those originally approved in the permit application. Affected lands were contained within <br />approved areas. Mining operations appeared to be in compliance with the conditions of the revised mine plan, <br />the Act and Rules. <br />Allegation of noncompliance with the approved reclamation plan The approved reclamation plan indicates <br />that affected lands will be reclaimed contemporaneously as operations progress. The amount of financial <br />warranty indicates that unreclaimed disturbances will be limited to approximately 9 acres. Mining operations <br />appeared to have affected approximately 1 acre beyond the 13 acres affected area observed during DMG's <br />10/8/98 field survey of affected and reclaimed lands. Total affected area on 5/18/99 was estimated at 14 <br />acres. However, approximately 5-6 acres of the total disturbance appeared to be in various stages of <br />reclamation. Observations made during the inspection and recorded within this inspection report indicate that <br />operations are being conducted in accordance with approved permit conditions, the Act and Rules. <br />5MT2020 Archaeological site, 5MT2020, was delineated by wire fence and sign. Evidence of mining <br />activities within the delineated site was not observed. <br />Financial Warranty On 10/13/98, DMG reviewed the cost of reclamation and determined that the existing <br />517,232 was sufficient to ensure reclamation, providing the operator complete application of revegetation <br />seed and mulch for approximately 3.7 acres area. On 10124!98, the operator informed DMG that application <br />of seed and mulch for the 3.7 acre area had been completed. DMG verified completion of backfill, grading, <br />topsoil replacement and application of seed and mulch during its 1 /29/99 inspection of the Stone Gravel Pit. <br />Affected area has not increased significantly since the 10/13/98 reclamation cost review, and the operator <br />has completed backfill, grading and topsoil replacement for additional lands.
