III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. Tom Bird represented the operator. The ground was dry as there had been no precipitation <br />for a few days. With the operator's consent, this report was issued from the Denver office. <br />Roads <br />The mine entrance road was well maintained. There was a fair amount of truck traffic and it was not <br />creating a dust problem. <br />Hydrologic Balance <br />The water level in both ponds was several feet below discharging. The culvert connecting the two <br />ponds appeared in good shape. Embankments and inslopes appeared stable. The primary and <br />secondary spillways appeared in good condition on both ponds. <br />The perimeter ditches on either side of the surface facilities area were in good condition. <br />We briefly discussed the need for baseline hydrologic monitoring in advance of new mine <br />disturbances. <br />Processing Waste <br />The waste pile showed no evidence of instability. The top of the pile appeared to slope gently back <br />from the face. The face was not Bullied or rilled. Ditches diverting water from the top of the pile were <br />in good condition. <br />
