III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made dunng <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement act;on <br />This was a complete inspection of the La Plata Coal Mine for the month of March, 2004. Present for the <br />inspection was Mike Savage representing the mine and Tom Rice representing the Ute Mountain Ute <br />Tribe. The purpose of this inspection was for final bond release that will be approved as soon as some <br />rocks are placed in the main channel to prevent any increased chance of erosion. <br />HYDROLOGIC BALANCE: The site is stable and other than the mam channel that drains the site, all <br />erosion is mirnmal <br />GENERAL MINE COMPLIANCE: The site is stable and all parties agreed that for a south facing slope, <br />the vegetation is outstanding. <br />RECLAMATION SUCCESS: Statistical analysis and onsite observations show this site has passed all <br />regwrements for a Phase III bond release. <br />
