III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Gillis of the Colorado Division of Minerals and Geology. Ross <br />Gubka represented the operator. Clear skies and dry ground prevailed at the time of the inspection. With the <br />operator's consent, this report was issued from the Durango office. <br />HYDROLOGIC BALANCE: <br />The operator is in the process of designing a new sediment pond for future pit areas; the plan is to construct the <br />pond ahead of time so it can be used to more economically manage current pit-dewatering operations. Drainage <br />control around the facilities area, box cut spoil pile, topsoil stockpile, and haul road were inspected and found to <br />be in compliance. The large 2-cell pond was also inspected and found to be functioning properly at the time of <br />the inspection. <br />3 <br />
