III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground site is entirely reclaimed. Ground <br />conditions on this day were dry and the weather was very hot. Mr. A.J. Iuppa. the <br />landowner at the site, opened the gate and the shop building allowing access to the <br />area. <br />Availabilitv of Records <br />The public copy of the mine records is kept at the shop building on the site. The <br />second quarter sediment pond inspection and refuse pile inspection were found as <br />required. The copy of the insurance certificate indicated coverage expired on <br />10/1/2000. Please place a copy of a current insurance certificate with the public <br />records. All other required records were found as detailed on the attached checklist. <br />Hydrologic Balance <br />The sediment pond at the site held a small amount of water. Cattails are abundant and <br />cover 90~ of the surface of the pond. The ditch system directing disturbed area runoff <br />appeared functional. Collapsable tubing on the steep sections of the clean water <br />diversion ditches are showing damage from weathering. The operator should consider <br />replacement or modification of these diversion structures. <br />Processing Waste <br />The refuse disposal pile was traversed on foot. No sign of slumps, slides, or damage <br />was noted. Seeps or springs are not active from the pile or the slope behind the pile. <br />The 100-year diversion ditch above the refuse pile was traversed along its entire <br />length. Sign of significant flow was apparent. As noted in the last month's <br />inspection, the site apparently experienced a heavy storm event that caused significant <br />runoff. No damage or breaching was noted on the 100-year ditch. Flows were easily <br />handled by the ditch and directed to the permanent drainage that crosses the site. Some <br />sloughage from the slope above the ditch was deposited in the lower section. This <br />material should be removed as necessary to maintain adequate ditch capacity. <br />Fish and Wildlife <br />Elk sign is abundant on the reclaimed area. <br />Page 3 <br />
