PROSPECTING ID ~_ <br />IPIS PECTIOLI DATE_ INSPECTOR' S INITIALS <br />OBSEP.VATIONS <br />This inspection was conducted in order to check compliance of the operation with the <br />requirements o£ State Statutes and Rules and the conditions of the permit as well as to <br />confirm the adequacy and accuracy of the map of the permit and disturbed areas received <br />1/19199. The map had been provided by the permittee in order to satisfy the corrective action <br />required for Compliance Problem 1 identified in the report of the Division's inspection of <br />the site on 9/10/98. The site was active at the time of the inspection. <br />The map supplied on 1\19\99 indicated an area disturbed by the mining operation in excess of <br />22 acres._The current 110 permit for the operation limits mining related disturbance to less <br />than 10 acres. The map also Indicates that the area of actual mining extends beyond current <br />permit boundaries onto adjacent BLM land for which the permittee has no right of entry for <br />mining. Taken altogether,this is considered a possible violation that is included on Pag= 3 <br />of this report. Prior to the inspection. a Reason to Believe Letter had been sent on January <br />29, 1999 as a result of this possible violation and the matter scheduled before the Mined <br />Land Reclamation Board during their March 24-25 1999 meeting. <br />The ID sign for the mine was in order. While the boundaries of the current 110 permiC area <br />have not been entirely marked in the field, as required by Rule 3.1.12 (2), they are <br />indicated on the surveyed map supplied of the permit and disturbed areas for the pit and it <br />is clear that the limits of the area disturbed by the mining operation extend well beyond <br />current permit area boundaries. Since it is this inspector's understanding that the permittee <br />now recognizes this possible violation of his permit and intends to convert the current 110 <br />permit to a 112, it would seem more realistic to mark the proposed boundaries of the 112 <br />permit rather than those of the current 110. <br />It is also this inspector's understanding that the current post-mining land use and <br />reclamation plans are no longer considered appropriate for the site. Under the currently <br />approved post-mining land use of wildlife habitat, all permanent structures would have to be <br />removed and a reclamation plan completed that calls for 2:1 and 3:1 slopes for the reclaimed <br />surfaces and the planting of shrubs. Re-establishment of the stream channel, now diverted <br />around the pit floor, would also be required. It would, therefore, appear that the best <br />interests of the permittee would be served by converting the current 110 permit to a 112 not <br />only in order to abate a possible violation based on having substantial mining related <br />disturbance outside of the current permit area boundaries but also to allow changes to be <br />proposed in the post-mining land use together with the mining and reclamation plans. <br />I& E Contact Address ^ CE <br />NAME Mr. John P.
