<br /> <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DMG staff <br />from the Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone <br />(970) 247-5469. Mine representative was not located on site. No mining and/or <br />reclamation activities were observed for the coal permit areas. Evidence of progress <br />towards reclamation of the site was not observed. <br />Mine identification sign was posted at the mine entrance. Permit boundary signs were <br />posted. Mine entrance gate was open. <br />Both sediment ponds, Ponds 1 & 2, were dry. Primary spillways were clear and stable, <br />no discharge noted. Open channel secondary spillways were well vegetated and <br />stable, no evidence of discharge. Vegetative cover for the pond embankments were <br />well established, evidence of embankment instability was not observed. <br />Weeds, including several varieties of thistle, were observed at the rock fill area, nos! <br />the topsoil pile partially disturbed for topsoil redistribution, g11d within the sediment <br />containment ditches for the MUA and the large sediment pond (Pond 1-, n~c! at the <br />pond inlet for Pond 1. DMG records do not indicate that the operator has seeded the <br />portions of the rock fill area where topsoil has been redistributed, or the topsoil <br />stockpile partially disturbed by the topsoil redistribution. <br />The operator is encouraged to immediately employ appropriate weed control methods <br />for areas infested by noxious weeds. If the operator does not intend to immediately <br />continue the topsoil redistribution activities at the rock fill area, the operator is <br />encouraged to immediately regrade the partially disturbed topsoil stockpile to a stable <br />slope configuration necessary to promote revegetation, and to take appropriate action <br />to ensure prompt establishment of a protective vegetative cover for the topsoil <br />remaining in the stockpile. The operator is encouraged to seed and plant areas where <br />topsoil redistribution has occurred, in accordance with permit conditions and the Act <br />and Rules. Failure to promptly establish an appropriate vegetative cover, following <br />topsoil redistribution, may result in violation of Rule 4.15.1(1-, (2) and (2)(b). Failure <br />to establish a protective vegetative cover of non-noxious weeds at the partially <br />disturbed topsoil stockpile may result in a violation of Rule 4.06.3(21(a)li). Failure to <br />protect topsoil from wind and water erosion and failure to minimize deterioration of the <br />biological, chemical and physical properties of the topsoil, during redistribution and <br />before and after it is seeded and planted, may result in a violation of Rule 4.06.412)(c) <br />and Id-. <br />
