Cattany <br />Acting Division Director <br />M-2000-067, Inspection Report Clarification. <br />Staff conducted an inspection of the above referenced permitted site on February 4, 2003. <br />The purpose of the inspection was to verify existing conditions at the site in conjunction <br />with possible enforcement action regarding the lack of adequate Financial Warranty as <br />required under Rule 4.2111). The inspection report from that visit is enclosed. <br />Beavers Construction will note two (2) problems cited within the report. The first is the <br />lapse of the Financial Warranty. This issue is listed only for reference as the reason for the <br />inspection and some general discussion. It is understood that the matter has the <br />operator's full attention. Staff is reviewing the calculated bond figures to see if any <br />current conditions can be used to relieve the amount required to reclaim the site, <br />This may require some commitments from the operator concerning total acreage disturbed . <br />and some earthwork to reduce the total site liability. Staff will be supplying more <br />correspondence on this issue within the next 5 days. <br />The second issue noted is the disturbance of areas outside the approved Mine Pian <br />Phasing. Although the disturbance is totally within the permitted area, the bond was <br />calculated using a phased approach to reduce the required Financial Warranty. Areas used <br />for stockpiling and working room appear to have impacted Phase 4. Fortunately areas <br />within Phase 1 have not been disturbed and this keeps Beavers Construction under the <br />total disturbance acreage of 13 acres approved under the permit. Concurrent to the <br />disturbance in Phase 4, it appears that topsoil stockpiles and stripping may be in Phase 3. <br />It is difficult to tell without markers for each phase. Staff is asking Beavers to submit a <br />Technical Revision (TR) to the Mining Plan that reflects the current disturbance and re- <br />phasing that matches current mining conditions. The TR should include a detailed map <br />and a narrative as to Beavers Constructions progression of mining at the site. Please <br />submit the TR and the required fee of 5188.00 to the Denver Office for processing by <br />April 14`h, 2003 as noted within the inspection report. <br />
