As you are probably aware, the question of <br />surface and ground water quality impacts was discussed thoroughly with <br />Mined Land Reclamation staff prior to approval of our permit by the Mined <br />Land Reclamation Board, and the Board was satisfied with the measures con- <br />tained in the reclamation plan. Prior to the Board's approval of the per- <br />mit for Logan Wash, joint meetings were held with representatives of the <br />Mined Land Reclamation staff, the Water Quality Control Division of the <br />Department of Health, and Occidental to clarify the allocation of responsi- <br />bility with respect to water quality as between the various state agencies <br />involved. The Board was apparently satisfied that Occidental would be <br />operating under the close supervision of the Water Quality Control Division <br />of the Department of Health with respect to both surface and ground water <br />quality. <br />Occidental operates at Logan Wash under an NPDES permit issued by the Water <br />Quality Control Division which regulates the discharge of water from mining <br />activities. This permit currently does not allow for the discharge of any <br />process-related water. We will continue to utilize all of the process water <br />collected in the retort sumps for steam production. No discharge of this <br />water is anticipated.
