III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground site is entirely reclaimed. Mr. A.J. <br />Iuppa, the landowner at the site, opened the gate access to the area. On this day the <br />weather was cold and windy with moderate to heavy snow showers. <br />Processin4 Waste <br />Visual ground observations were somewhat limited due to the snow cover. The south- <br />facing slope of the refuse highwall was traversed on foot. No sign of slumps, slides, <br />or damage was noted. It did appear the contour furrows had been cleaned in the past as <br />identified in a letter from Energy Fuels Mining Company dated January 15, 2001. It <br />also appeared that Refuse Collection Ditch no. 2 had been re-shaped. The inspector <br />noted that a number of the cleaned contour furrows have breached and will not perform <br />as designed unless those breaches are repaired and maintained on a regular basis. <br />Breaching higher on the slope seems to cause progressive failure of those furrows on <br />the slope immediately below. <br />Seeps or springs were not noted from the refuse highwall area. <br />Overall, the site appeared in normal condition for the winter season. Moisture from <br />snow cover should benefit inter-seeding efforts. <br />Page 3 <br />
